By the present appeal, the appellant challenges the order dated 10.8.2022 passed by the learned Principal District Judge, Aurangabad in Civil Misc. Application No. 125/2021 filed under section 9 of the Arbitration and Conciliation Act by which the present applicant was restrained from carrying on business of partnership in the firm M/s. Baheti Enterprises under licence and under sections 154 and 155 of the Explosive Act, 1884.

Notice was issued to the original applicant in this appeal filed under section 37 of the Arbitration and Conciliation Act 1996. Original applicant has filed affidavit in this Court wherein it is stated that the compromise has been taken place between the parties and he has

Arb. Apl. 14/24 withdrawn the criminal proceedings against the present appellant and he has also filed no objection to allow the Civil Misc. Application No. 125/2021 and also stated that he has no objection for granting to the appellant renewal of licence under the Explosive Act in the name of M/s. Baheti Enterprises.

Considering the above submissions and affidavits filed in this Court, it appears that the dispute is amicably settled between the parties. The impugned order is quashed and set aside in view of the response filed by the respondent. Appeal is disposed of accordingly. ( ARUN R. PEDNEKER, J. ) ssc/
