Learned Additional Public Prosecutor makes a statement that the charge-sheet is filed and cognizance is taken. The present writ petition is filed under Article 226 of the Constitution of India as well as under Section 482 of the Code of Criminal Procedure, 1973. Once the cognizance has been taken, the remedy of filing writ petition under Article 226 is not available to the petitioner. Therefore, this writ petition is treated as an application under Section 482 of the Code of Criminal Procedure. In view thereof, Registry shall place the application before the appropriate Bench.
