The order impugned in this Petition was passed on November 8, 2022. By the said order, the Learned Arbitral Tribunal had refused to grant protective reliefs to the Petitioner in terms of the appointment of a new developer.

It is common ground that the new developer has already been appointed in 2024, during the pendency of this Petition. Consequently, this Petition has been rendered infructuous.
