In this case, we find that the Bank of Baroda has been delaying the matter. Firstly, despite service they chose not to appear and therefore, this Court, on 6th March 2025 had to direct that a fresh notice be issued to the bank. This order also clarified that an endeavor would be made to dispose of this petition finally at the admission stage. 2.

On 12th June 2025 the Advocate for Bank of Baroda did not remain present and the matter was adjourned to 19th June 2025.

Today, when the matter was called out, learned

33-WP-903-2024 (OS).DOCX counsel for the bank states that he has authority only to seek an adjournment and nothing further. He seeks for some time to file reply.

The matter has been delayed sufficiently. Therefore, as a last chance, we grant the bank, time to file its reply latest by 17th October 2025.

If the reply is not filed by 17th October the bank will forfeit the opportunity of filing the reply and the matter would be heard finally at the admission stage on the premise that the bank does not contest the factual averments in the petition.

If the petitioner wishes to file any rejoinder, such rejoinder should be filed and served latest by 7th November 2025.

List the matter 14th November 2025 for final disposal at the admission stage.
