We have gone through the report dated 8 April 2026 pursuant to the directions of this Court by an order dated 6 August 2025.

The learned Counsel for the respondent / MHADA submitted that the Executive Engineer has been accordingly directed to take appropriate steps to ensure that the grievance of the petitioner is redressed.

In light of the communication dated 8 April 2026, MHADA is bound to comply with the said order dated 8 April
Mamta Kale 8-wp-1470-2025.doc 2026 expeditiously and in any event within a period of 12 weeks from the date of communication of this order. 4.
The learned Counsel for the petitioner submitted that in terms of Regulation 34 of the Maharashtra Housing and Area Development (Estate Management, Sale, Transfer and Exchange of Tenements Regulations, 1981), in Clause(4), it has been provided that "if any occupier cannot be accommodated in the reconstructed building, the Competent Officer, shall provide him with an alternative accommodation in any transit camp or in any other reconstructed building on the basis of his seniority in the Master List maintained for the purpose depending upon the period of his stay in the transit camp." Obviously, when the steps are taken by the Executive Engineer, Regulation 34 and other appropriate Regulations applicable shall be taken into consideration.
