Mr. Shenoy, learned Counsel for the RBI and Mr. Kachare, learned Counsel for CBI, both have submitted that after the Judgment of the Hon'ble Supreme Court in the case of State Bank of India and Others vs. Rajesh Agarwal and Others1, the core issue raised in the Writ Petition is now covered inasmuch it is now mandatory requirement of law that before fraud declaration, the principles of natural justice would have to be complied with by the authorities. Therefore, it is submitted that the Writ Petition be disposed of with suitable direction. Such an order cannot be passed today in absence of the Petitioner's Counsel.
