1. Perused Petition. Heard Ld. Advocate for Petitioners. This Petition is for Probate of Last Will and Testament and Codicil of the deceased filed by Petitioners Gurdeep Kaur Chawla, Ricky Satinder Pal Singh Gulati and Manpal Singh Gulati being the Executors named under the Will of the deceased. Deceased Mehtab Singh Gulati said to have died at Vashi/ Navi Mumbai on 17.01.2021. Copy of Death Certificate is annexed to the Petition. Identification proof of the deceased i.e. Copy of Pan Card is annexed to the Petition.

2. Mr. Gupta, Advocate for the Petitioner submits that deceased left behind him last Will and Testament and Codicil which was duly executed at Thane on 30.12.2013 and 18.01.2020 respectively. The said Will and Codicil are in English language.

3. Mr. Gupta, Advocate for the Petitioner submits that deceased was governed under the Hindu Succession Act, 1956. It is submitted that the parents of the Deceased have pre-deceased the Deceased. Son of the deceased Satinder Pal Singh Gulati died on 07.10.2016. The said Satinder Pal Singh Gulati has no daughter and other sons. The deceased have no other daughters and other sons. Save and except as mentioned in para - 9, there are no other legal heirs left by the

4. Petitioner's Oath is filed. Consent Affidavit of daughter in law of the deceased as mentioned in Para 9 is on record. Affidavit of Clayton John D'souza, one of the attesting witness to the Will and Codicil are filed. Affidavit of service of General Citation is filed. All other legal formalities are complied with. Hence, Petition is granted.

5. Office to issue Probate as prayed after verifying whether any Cross Petition or Caveat is filed.
