TP/269/2024 Mr. Santosh Vhatkar, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioners namely Usha Keshav Shriyan and Ratna Raghava Shrigar being married daughters of deceased. Deceased namely Girija Shama Rao said to be died intestate at Mumbai on 04.06.2016. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pancard is already annexed to the petition.

2. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Husband namely Maroli Shama Rao died on 06.11.2017. Deceased had two sons and two daughters. One son namely Manohar Shama Rao died, leaving behind his wife and two sons. Petition is filed by two married daughters of deceased and rest of the legal heirs have filed the consent Affidavits in favour of petitioner. Consent Affidavits are on record. There are no other legal heirs.

3. Earlier one TP No. 2680 of 2018 was filed by son of deceased namely Manohar Shama Rao for grant of Succession Certificate as to the securities and debts for the deceased and grant was issued. Copy of the grant issued in the said Petition is annexed to the petition as Exhibit - "E". Ld. Advocate for petitioner submits that the said grant was surrendered by them in this Registry on 27.03.2025. After grant was issued petitioner therein namely Manohar Shama Rao died on 11.02.2021 without administering the properties of deceased. Therefore, this petition is filed.

4. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 20.02.2024 and Administration Bond dated 18.02.2024 are filed. Delay is explained. All other legal formalities are complied with. Hence, petition is granted.
