This petition is for Succession Certificate in respect of certain securities belonging to both the deceased filed by petitioner namely Rustom C. Patel being son of both the deceased. Deceased No. 1 namely Cawasji N. Patel died intestate at Mumbai on 04.10.2011. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 19.03.2023 for dispensation of Identification proof of deceased. The same is accepted.
Deceased No. 2 namely Banubai Cawsji Patel died intestate at Mumbai on 01.03.2001. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 19.03.2023 for dispensation of Identification proof of deceased. The same is accepted.
2. Ld. Advocate for petitioner submits that both the deceased had three daughters and two sons. One daughter namely Perwin J. Dumasia died on 13.8.2018, leaving behind one son and one daughter. Deceased was survived by two daughters, two sons, one granddaughter and one grandson. Out of them one son is petitioner herein and all other legal heirs have given their consents in favour of petitioner. Consent Affidavits are on record. There are no other legal heirs.
3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 11.03.2025 and Administration Bond dated 21.03.2025 is filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.
