1. Ld. Advocate for the petitioner has submitted a photo copy of his petition, as the department has not produced the record and proceedings for numbers of hearing. He submitted that he has carried out an amendment in the legal heirs as per the order of the Hon'ble Court, due to the death of the Petitioner No.

1. Hence citation is required to be issued to nonconsenting legal heirs.

2. Ld. Advocate for the petitioner submitted that after the death of petitioner No. 1, his legal heirs are mentioned in the petition. The said legal heir is not consented, hence, citation may be issued to the said legal heirs.

Hence, citation is issued. Department to issue citation to the non-consenting legal heirs of the deceased, if any. Advocate is directed to take steps and ensure that requisition under chapter XXVI of the Bombay High Court (O.S.) Rules, 1980 (for short "BHC Rules") are complied with.
