TP/2166/2024 WITH WILL/899/2024 Mr. T. Monis i/b. ALJ and Partners, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. In the present petition, it is mentioned that deceased was divorcee of Behram Dubash and no document is annexed to that effect. Upon perusal of the Will, it has been found that there is no averment with respect to the husband of deceased. It is mentioned in the petition that deceased was married to the said Behram Dubash but divorce and from 46 years she has been single / divorcee and deceased was survived by daughter who is executor / petitioner herein. Except the statement, there is no documentary evidence showing that the deceased was divorcee.
2. As the petitioner states that there is divorce between husband of deceased and deceased and copy of divorce decree not annexed to the petition. Hence, Ld. Advocate for petitioner require to seek directions from the Hon'ble Court with respect to the dispensation of the said requisition.
