Mr. Vani, Learned Counsel appearing on behalf of the Petitioner has today placed reliance upon an Affidavit of Service dated 8 th January 2025, which proves service upon one Sadhana Basrur, named as Executor in the Will, which is being propounded in the captioned Testamentary Petition as being the Last Will and Testament of one Chanrakant Laxmanrao Basrur (the deceased). The said Affidavit has appended to it a citation which was served on Sadhana Basrur. She submits that despite service of this citation, Sadhana Basrur has not come forward to take any steps nor she come forward to renounce her rights as an Executor.

Therefore I find that the need for the Petitioner now to comply with the requisitions as raised by the Additional Registrar, Original Side/Additional Prothonotary and Senior Master vide an order dated 14 th October 2024 does not arise. The same is accordingly dispensed with. 4.
