1. Records and proceedings not available. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Rekha Amarnath Sanghvi being one of the alternate Executrix named under the Will of deceased. The deceased namely Chandrika Nyalchand Sanghrajka died at Mumbai on 07.06.2010. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 30.12.2009. The said Will is in English language. The Page No. 1 of the Will refers to the appointment of Executor. Only four Executors appointed under the Will. First Executor namely Nyalchand Sanghrajka has renounced his rights to act as an Executor and Affidavit dated 01.11.2025 is filed to that effect. Petitioner is one of the alternate executrices and other alternate executors namely Praful Sanghrajka and Nita Shah have renounced their rights to act as an Executors and Affidavits dated 01.11.2025 and 13.11.2025 are filed to that effect respectively.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was survived by her husband, one son and two daughters. Out of them daughter is petitioner herein and Husband, son and another daughter have given their consents in favour of petitioner herein. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Ajit Kucheria dated 18.04.2022 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 29.07.2025 is filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
