TP/2563/2024 Mr. Arnold Fernandes i/b.Vivek Sharma, Advocate for petitioners PC : 1. Perused Petition. Heard Ld. Advocate for petitioners. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Soeb Zainuddin Bandukwala and Munaf Zainuddin Bandukwala being Executors named under the Will of deceased. The deceased namely Zainuddin Abbasbhai Bandukwala died at Mumbai on 17.02.2020. Copy of death certificate is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 21.08.2017. The said Will is in English language. The Para No. 4 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will who are petitioners herein.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased was survived by three sons. Out of them two sons are petitioners herein and the remaining son has given his consent in favour of the petitioners. Consent Affidavit is on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Mohan Chavare dated 14.07.2022 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 19.10.2024 and Administration Bond dated 12.11.2024 are filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
