This Court by an order dated 6 th December, 2024 directed the Applicant to file an additional affidavit in support of dispensation with the requirement of filing a Judges Order for opening and taking inventory of a bank locker of the deceased standing in State Bank of India, Kurla Branch. Learned Counsel submits that the additional affidavit has since been filed. She invites my attention to the averments made therein and points out that on 1 st November, 2021, the said bank locker was opened in the presence of the following individuals:
a) Smt. Rasika Tawade, Service Manager.
b) Shri. Kaustabh Sawant, Officer.

d) Shri. Mayur Jain and Shri. Manoj Jain, witnesses and valuer. e) Rahul Chautel, Anoushka Chautel and Yogesh Chautel, legal heirs of the deceased.

She submits that therefore this requires dispensation with. She additionally submits that the detailed inventory of the contents of the locker was prepared by the bank officials. In view of what has been stated in the additional affidavit, I deem it fit to dispense with the said requirement since the same has already been completely carried out. The inventory prepared by the State Bank of India and appended to the additional affidavit shall be accepted for the purposes of the captioned Testamentary Petition.

Hence, the said objection is dispensed with.
