TP/5042/2024 WITH WILL/2009/2024 Mr. Rajesh Kanojia, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Prakash Ramrao Pise being one of the Executors named under the Will of deceased. The deceased namely Ganesh Ramrao Pise died at Mumbai on 08.06.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 12.09.2017. The said Will is in English language. The Page No. 3 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will. Petitioner is one of the executors and Affidavit of another executor namely Rajesh Kanojia has renouncing his rights to act as an executor and Affidavit dated 20.11.2025 is filed to that effect. The properties mentioned in the Schedule are shown in para No. iii to vi of the Will.

3. Ld. Advocate for petitioner submits that mother of deceased predeceased the deceased. Deceased died as bachelor. Deceased was survived by father, one brother and two sisters. Out of them brother is petitioner herein and father has given her consent in favour of the petitioner. Consent Affidavit is on record. One sister of deceased namely Sangeeta has been served through newspaper publication and Affidavit of Service dated 05.08.2025 is filed to that effect. Affidavit of Service of sister of deceased namely Lalita dated 12.03.2025 is filed. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Rajiv Pillai dated 22.12.2022 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 17.12.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
