That the tax effect in this appeal is less than two crores. Mr. Suresh Kumar submits that when the appeal was instituted, the prescribed selling amount was one crore. 2.
However, it is well settled that CBDT notifications would apply to the pending appeal as well.

Accordingly, at the instance of Mr. Suresh Kumar, we permit the withdrawal of this appeal with liberty to seek revival in case it is found that the appeal falls within any of the specified categories.

We accept that such application be filed within a reasonable period with by 31st January 2026. The questions
