The learned Advocate appearing for the Petitioner has sought leave to withdraw the Commercial Arbitration Petition on the ground that the parties have arrived at a settlement and Consent Terms have been filed in Commercial Arbitration Petition No. 351 of 2024 under Section 9 of the Arbitration Act.

In Clause 16 of the said Consent Terms dated 3rd October 2024, the parties have agreed and undertaken to withdraw 1/2

7-CARBP-32-24.doc unconditionally the captioned Commercial Arbitration Petition along with the other Commercial Arbitration Petitions. 3.

In view thereof, taking note of the Consent Terms dated 3rd October 2024 and in particular, Clause 16 thereof where the parties have agreed to unconditionally withdraw the captioned Commercial Arbitration Petition, leave is granted to the Petitioners to withdraw the Petition.

The Commercial Arbitration Petition No. 32 of 2024 is accordingly, disposed of as withdrawn.

Court fees are to be refunded in accordance with the Rules. For the purposes of Section 43 of the Maharashtra Court Fees Act and the proviso to that Section, today's date is the date of making a claim for repayment. The Prothonotary & Senior Master will issue a certificate for a refund of Court Fees computed according to the Rules.
