This is a petition under Section 9 of the Arbitration and Conciliation Act, 1996 ("the Act"). Learned Counsel for the Respondent seeks a short accommodation in the matter stating that he has been brought board only in November last year and wants time to assess the matter. 2.

Heard the parties at some length. To adjust equities, purely as a pro tem measure, the Respondent shall deposit a sum of Rs.15 Crores with the Registry of this Court no later than March 10, 2025. Learned Counsel for the Respondent also fairly states that on the next occasion he would come with the name of the arbitrator before whom the Respondent may be willing to proceed to arbitration, so that the Arbitral Tribunal may deal with the issues considering the disputes and difference between the parties. In these circumstances, list under the caption "Part Heard - Section 9" on March 11, 2025.

Tag this matter along with Commercial Arbitration Application (L) No. 38191 of 2024, which is an Application under Section 11 of the Act, and list them together on the next occasion. Learned Counsel for the Petitioner submits that he shall serve a copy of the Section 11 Application on the Respondent, no later than February 14, 2025. 3.
