Pursuant to order dated 7th February, 2025, when the matter is called out, Mr.Pranjit Bhattacharya, learned Counsel appears through video conferencing and submits that he is representing Prudent ARC Limited who has come in place of IDBI Bank Limited as the debt has been completely assigned in favour of his client. Mr.Bhattacharya, learned Counsel at the out set therefore seeks some time to file an appropriate application to substitute the assignee of the debt in place of Defendant No.2-IDBI Bank Limited.

As regards this Interim Application is concerned, Mr.Bhattacharya seeks time to file Reply submitting that earlier time was granted to IDBI Bank Limited to file Reply to this application. 3.

Ms.Krushi N. Barfiwala, learned Counsel appearing for the Plaintiff-Port Authority submits that while she has no objection if an application for substitution is filed and even a Reply to this Interim Application is filed, however, drawing this Court's attention to the order dated 22nd November, 2022, whereby the priorities of the claims have been determined, learned Counsel submits that the Port Authorities' dues are ranked at second priority and the claim of IDBI Bank Limited is ranked at third priority.

Be that as it may, let the necessary application and reply be filed within a period of two weeks with a copy to the other side. Rejoinder in a week thereafter with a copy to the other side. 5.
