At the request of Ms. Patil, learned counsel for Respondent No.1 to take instructions as to whether the matter can be remitted back for fresh consideration.

Since it is submission of Mr. Khadilkar, learned counsel for the Petitioner that the rejection is only on the ground of insufficiency of disclosure. He has also placed reliance upon the order passed by this Court in the case of Hemant Karamchand Rohera Vs. Controller General of Patents and Designs & Anr. i.e. th November 2025 passed in Commercial Miscellaneous Petition order dated 17 No.11 of 2022, in which this Court had remitted the matter back to the controller in similar facts.
