Interim Application No.832 of 2024 is taken out, seeking condonation of 53 days delay in filing the Appeal under Section 37(2)(b) of the Arbitration and Conciliation Act, 1996. 2.
Heard the learned counsel for the Applicant and perused the Application.
The order against which the Appeal/Petition is filed, is an ex-parte order and the Application proceed to state that the Applicant was not aware of the said order being passed and, M.M.Salgaonkar
2/2 30 IA-832-24.odt since, the Petition is filed immediately upon gaining knowledge of an ex-parte order being passed by the learned Arbitrator under Section 17, the present Application is filed. 3.
On perusal of the Application, since I am of the opinion that the reasons cited therein are bona fide and, since, the Applicant deserve an opportunity for assailing the order, Interim Application is made absolute in terms of prayer clause (a).
