Interim Application has been preferred seeking condonation of delay of 1731 days caused in filing affidavit of proof of debt with the Official Liquidator.

Learned Counsel appearing for the Applicant submits that the Applicant reside in remote village in West Bengal and unware of the notice inviting claims. He submits that as such he was unable to file the affidavit of proof of debt with the Official Liquidator. Shubham 1 of

Mr. Sheth, learned Counsel appearing for the Respondent does not fairly oppose the Application. For the reasons stated in application the delay of 1731 days is condoned. 4.

The Official Liquidator is directed to accept the affidavit of proof of debt and adjudicate the same in accordance with law and on its own merits.
