This is an application seeking leave of this Court under Section 446 of the Companies Act, 1956 to proceed with Suit No.4943 of 2011, which is pending before the City Civil and Sessions Court, Mumbai. 2.

Ms. Goyal, learned counsel for the Official Liquidator submits that the Official Liquidator would not have any opposition to this Interim Application being allowed. However, the Applicant would have to put the Official Liquidator in funds to prosecute the Suit. She submits that initially a deposit of Rs.1,00,000/- may be made and in the event further funds are required, the same would be intimated to the Applicant by way of a letter on the Applicant's undertaking to make payment of the same.
