Heard Mr. B. Sardessai, learned counsel for the applicant.

2. This is an application under Section 11(6) of the Arbitration and Conciliation Act, 1996 for the appointment of Arbitral Tribunal. Mr Sardessai would submit that by an agreement executed between the applicant and the respondent, it was agreed between the parties that any dispute or differences shall be referred to the Arbitral Tribunal consisting of three arbitrators.

3. Mr Sardessai, would submit that since the dispute arose, the applicant invoke clause 33 for the purpose of appointment of Arbitral Tribunal and suggested the name of the arbitrator. Though such notice was forwarded by registered post, it returned unclaimed.

4. Issue notice to the respondent returnable on 2.5.2024. Apart 3rd April, 2024
