IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD CIVIL APPLICATION NO. 2891 OF 2024 IN WP/54/2024 SANDIP TRIMBAK GOSAVI AND OTHERS
VERSUS
THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND OTHERS ...
Mr. Arvind Gopalrao Ambetkar, Advocate for Applicants. Mr. S. S. Dande, AGP for Respondent-State.
...
CORAM : SMT. VIBHA KANKANWADI AND S. G. CHAPALGAONKAR, JJ.
DATED : 14th MARCH, 2024.
P.C.
1.
The present application has been filed for recalling order dated 09.01.2024 passed in Writ Petition No.54/2024. By order dated 09.01.2024 the notices were issued to the respondents and were made returnable on 20.02.2024. However, in the same order it was mentioned that office objections should be removed on or before 08.02.2024, failing which the petition would stand dismissed without reference to this Court on 09.02.2024. Under the said circumstance, when the petitioner failed to remove office objections as stated in the order, it is taken that writ petition is dismissed and, therefore, notice to other respondents was not even issued. Under the said circumstance, it is not necessary to issue notice to respondent nos.4 to 11 in the Civil Application. 2.
Now the learned Advocate for the applicant has shown readiness to remove office objections within a period of one week.
(2) 912-ca-2891-2024.odt 3.
In view of the said statement, Civil Application stands dismissed without reference to the Court.
4.
Place the matter for further consideration, in case office objections are removed on 28.03.2024.
(S. G. CHAPALGAONKAR) (SMT. VIBHA KANKANWADI) JUDGE JUDGE Devendra/March-2024
