After arguing for some time this matter, Mr. Narwade, learned counsel for the petitioner, seeks leave to withdraw the present petition with liberty to file appropriate legal proceedings for the purpose of protecting his injunction.

Leave is granted as prayed for. The petitioner may take appropriate legal remedy as his permissible in law. If an application is filed by the petitioner, the learned Civil Judge shall deal it on its own merit and as per the law.

The Writ petition is disposed of as withdrawn with liberty as aforesaid.
