This Court by order dated 8 January 2024 granted adinterim relief in terms of prayer clause (c). This Court also directed that the coercive steps taken against the petitioner shall stand vacated forthwith.

This order was pointed out to the School Tribunal. Though this Court directed that the coercive steps shall stand vacated forthwith, the School Tribunal on an application for return of movable property has postponed the hearing of the application to 23 January 2024.

The School Tribunal being manned by a Judicial Officer, it is expected that the order of superior Court should be complied with in its letter and spirit. It was, therefore, expected of the School
901-wp119-2024.doc Tribunal to issue consequential directions against the concerned persons forthwith. However, it appears that the School Tribunal is insensitive to the letter and spirit of order passed by this Court on 8 January 2024.

Hence, the application dated 10 January 2024 below Exhibit 54 stands allowed.

It is directed that the movable property of the petitioner shall forthwith be released in favour of the petitioner. (AMIT BORKAR, J.)
