We have heard the Learned Advocate for the Petitioner. The Petitioner is working as a Senior Section Engineer / Track Machine with the Railways Department. A disciplinary proceedings has been initiated. After the filing of this petition the proceeding has been concluded and certain orders have been passed by the employer.

Considering Section 3(q) and 15(1)(b) of the Administrative Tribunals Act, the Petitioner will have to approach Meera Jadhav

2-wp-151-24.odt the Learned Central Administrative Tribunal. The Learned Advocate for the Petitioner submits that this matter may be transferred to the Tribunal.

In view of the above, this Writ Petition, along with the Interim Application No.107 of 2024, are disposed off from the file of this Court. The registry is directed to transfer this proceeding to the Learned Tribunal at Mumbai within 7 days from today. The Ad-interim protection granted by this court on 27th February, 2024 would be continued till 15th January, 2025. We make it clear that the Interim Application before the Tribunal would be considered on its own merits without being influenced by the ad-interim protection granted by this court.
