On 23.8.2024, this court recorded that the Respondents who are served with court notice, shall file their affidavit in reply before the next date and if it is not filed, it would be presumed that they are not contesting the Petition and the Court will proceed on this basis. 2.

We are informed that Respondent Nos. 1 and 2 have not

filed their affidavit in reply. The Petitioner's application dated 8th June, 2023 seeking benefits of the 6th Pay Commission and 7th Pay Commission Recommendations, which were payable to her deceased husband, should be paid to her, is pending. Her husband passed away while in service.

Despite service of notice on the College, which is supposed to have a Grievances Redressal Committee at the level of College, none appears today, in as much as no reply has been filed. 2.

In view of the above, and considering the law laid down by the Hon'ble Supreme Court in Secretary Mahatma Gandhi Mission & Anr. v/s. Bhartiya Kamgar Sena & Ors.1 and by Aurangabad Bench in Bhartiya Kamgar Sena & Anr. v/s. State of Maharashtra & Ors.2, we direct Respondent Nos. 1 and 2, to ensure that its Grievances Redressal Committee deals with the representation dated 8th June, 2023 filed by the Petitioner widow, by following the due procedure laid down in law within a period of 60 days from today.

Since the learned Advocate for Respondent Nos. 1 and 2 is absent, the Petitioner would serve a copy of this order obtained from (2017) 4 SCC 449 Writ Petition No. 14395 of 2019

the official website of the Bombay High Court, on Respondent Nos. 1 and 2, by speed post A/D, within 15 days from the date of up loading of this order.

The Petition is disposed off accordingly.
