As the issue is raised by the petitioner as to whether the Additional Chief Secretary can pass order not being the Appellate Authority under Section 47 and 53 of "Maharashtra Regional and Town Planning Act", though learned AGP has tried her best to convince this Court on the basis of letter dated 02.02.2024 that as per the directions of the Hon'ble Chief Minister the order has been passed, this Court is not convinced to accept the said submission for want of any rules of business on provisions of law in support thereof.

Learned AGP for the State seeks time to make further submission in this regard.
