By this petition, the challenge is to the order of rejection of proposal of individual approval of the petitioner by relying upon the Government Resolution dated 11th December 2020. 2.
According to the learned counsel for the petitioner, the said G.R. is not applicable in the case of the petitioner, as his appointment was made prior to the coming into force of the said Government Resolution. 3.
It is the submission of the learned counsel for the petitioner that his appointment is of dated 1st March 2018 and was made by following due procedure of law. However, this aspect was not properly considered ZIP

In addition to this, it is also submitted that if the hearing opportunity could have been given by the Education Officer, all these factual aspects would have been properly brought to the notice of the Education Officer in the matter. However, in the absence of such hearing opportunity, the facts which are relevant are not brought to the notice of the Education Officer and consequently, the impugned order came to be passed.

In the light of this factual position, the matter is remanded back to the respondent No.3 - Education Officer (Secondary), Zilla parishad, Sangli, and the proposal dated 25th March 2022 is restored . 5.
The Education Officer is directed to reconsider the proposal dated 25th March 2022 by granting hearing opportunity to the petitioner and all the stakeholders in the matter, and thereafter, pass the appropriate order after hearing the parties in the matter. 6.
The aforesaid exercise be completed within a period of 12 weeks from the date of production of this order.
