The petitioner is aggrieved by an order passed by the learned District Judge, whereby an application preferred by the petitioner to condone the delay of five years, seven months and thirteen days in filing the appeal against a judgment and decree passed by the Court of Small Causes at Pune in Special Civil SANTOSH SUBHASH KULKARNI SANTOSH SUBHASH KULKARNI Date: 2026.01.27 20:11:58 +0530 Suit No. 1575/2011, came to be dismissed.

The proper remedy for the petitioner is to prefer a second appeal against the said order of the dismissal of the application for condonation of delay.

The petition stands disposed with liberty to the petitioner to file a Second Appeal.
