At the outset, Mr. Kanawade, learned counsel for the petitioner would submit that a statutory and efficacious remedy is available to the petitioner to challenge the order impugned in the present petition. He would submit that a revision/appeal would lie before the Joint Registrar, Co-operative, Chhatrapati Sambhajinagar. 2.

He would further submit that he is in contact with the Bank with an object to settle the matter; however, since the petitioner's wife was suffering from cancer, he is falling short of funds to settle the Shrikant Malani

Mr. Kanawade, learned counsel for the petitioner, seeks leave to withdraw the present petition with liberty to file the appeal / revision before the Joint Registrar Cooperative. Leave is granted. The petition stands disposed of with liberty as aforesaid. 4.

In the event the petitioner files any revision or appeal before the Joint Registrar Cooperative, Chhatrapati Sambhajinagar, the said authority shall consider the point of limitation keeping in mind the pendency of this writ petition in this Court. All contentions are kept open.
