Heard the learned counsel for the petitioner, it is contended that the respondent No.1 as well as respondent No. 6 were appointed on the same date and placed in Category "C" of Schedule "F" of the Maharashtra Employees of Private Schools ARUN RAMCHANDRA SANKPAL (Conditions of Service) Regulation Act, 1977 ("MEPS Act") inspite by ARUN RAMCHANDRA SANKPAL Date: 2024.07.09 14:29:32 +0530 of which, the learned Tribunal, by the impugned Judgment dated 13.10.2023, though he finds, that the respondent No. 6 is senior to the respondent No.1, has directed the respondent No. 1 to be Arun Sankpal

5-WP-936-2024.doc reinstated as the headmistresses, as the respondent No. 6, has not complained about the promotion granted to respondent No.1 by filing an Application under Section 9 of the MEPS Act within a reasonable period (page 234).

Issue notice to the respondents for final disposal returnable on 05.08.2024.
