We have heard the learned counsel for the respective parties. 2.

We were not inclined to entertain the petition, however, Mr. Ganu, learned counsel appearing for the petitioner fairly seeks liberty to the petitioner to make a fresh representation to respondent nos.1 to 3Maharashtra Industrial Development Corporation ("MIDC") and on this count, seeks leave to withdraw petition.

We permit the petitioner to withdraw the writ petition with liberty to make a fresh representation to respondent nos.1 to 3-MIDC. 4.

We however clarify that in permitting the petitioner to make a representation, we have not delved or recognized any legal right of the Rajesh Chittewan, PA

Petition is accordingly allowed to be withdrawn, subject to the above observations.
