Present Writ Petition takes exception to the order dated 03.11.2022 passed by learned Trial Court in Application below Exh.33 rejecting the Application filed under O. VII, R. 11(b)(c) and (d) of the CPC as also the order dated 21.07.2023 passed in Application below Exh. 63 rejecting Review Application filed under O. XLVII, R. 1 of the CPC.

Heard Mr. Sabale, learned Advocate for Petitioners. 5.

Issue notice to the Respondent Nos. 1 and 2 who are the principal contesting Respondents made returnable on 05.04.2024. Humdast permitted. In addition to Court's notice, Petitioners are directed to serve copy of the Petition along with copy of this order on

CIVIL WP-1544-2024.docx the said Respondents and inform them about the next date of hearing by any permissible mode of service and file appropriate affidavit of service with tangible proof thereof on or before the next date. After receiving the notice, Respondents to file affidavit-in-reply on or before the next date, if so desired with an advance copy to the Advocate for Petitioners.

Respondent Nos. 1 and 2 are directed to remain present either themselves or through their Advocate on the next adjourned date. It is made clear that if Respondents remain absent despite service on the next adjourned date, this Writ Petition shall be heard and disposed of at the stage of admission in the absence of the Respondents. 7.
