The Petitioner's father passed away on 8th September, 2006. The widow moved an application on 14th March, 2006 for compassionate appointment. On 3rd September, 2007, the widow changed her mind and moved an affidavit seeking appointment of the Petitioner on compassionate basis, when he was only 12 years old. Apparently, the application was not maintainable. The resultant effect is that the widow did not take the appointment on Nikita
7-wp-1686-2024.odt compassionate basis and waited for all these years to enable her son to become an adult. Now the widow has crossed 45 years of age, and the Petitioners is 30 years of age.

Issue notice to the Respondents, returnable on 3rd February 2025. The learned AGP waives service of notice on behalf of Respondent No.2.

Let the affidavit-in-reply be filed at least 10 days prior to the returnable date in this matter.
