1] Heard the learned counsel for the petitioner. 2] By the impugned order dated 01.08.2023, the Principal District and Sessions Judge, Osmanabad has passed the following order :

ORDER

Application is allowed.

2.

HMP No.01/2018 pending on the file of Jt.Civil Judge, Senior Division, Omerga and PWDV application No.15/2016 pending on the file of 3rd Jt.Civil Judge, Junior Division, Omerga are hereby withdrawn and transferred to the file of 2nd Jt.Civil Judge, Senior Division, Osmanabad for disposal according to law.

The parties are directed to appear before the concerned Court on the given date.

The office is directed to intimate this order to all the concerned.

1927.24WP 3] Considering the above order, PWDV Application No.15/2016 being criminal in nature writ petition challenging to transfer order would lie before the criminal side and as regards HMP No.01/2018 being civil in nature, writ petition would lie before the civil side. 4] The petitioner submits that there is urgency in the matter. In view of the same, the registry to verify the roster by 20.02.2024 and place this matter before appropriate Bench.
