The learned counsel for the petitioner submits that the proceedings are initiated in the year 2015 and no complaint is made by the respondent/husband unitl the filing of transfer proceedings as to the influence being exerted by the father of the petitioner being an advocate practicing in the same court. The learned counsel submits that the proceedings being criminal in nature, evidence in the matter is available in Umerga and the transfer to any other Court would make it difficult for the petitioner/complainant to establish her case at the transferred place in Osmanabad which is nearabout 75 k.m. away from Umerga . 2.

Issue notice to the respondents, returnable on 19.3.2024. In addition, Hamdast permitted.

There shall be ad-interim stay to the transferred proceedings bearing H.M.P. No. 1/2018, originally filed before the Civil Judge, Senior Division, Umerga and PWDV Appln.No. 15/2016, originally filed before the Judicial Magistrate, First Class, Umerga which are transferred to Civil Judge, Senior Division, Osmanbad.
