IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO.2297 OF 2025 Rupali Nitin Aher ....Petitioner
Versus
The State of Maharashtra and Ors.
....Respondents ---- Mr. Vilas B. Tapkir for the Petitioner.
Mr. P.P. Kakade, Addl. GP a/w. Ms. Nisha Mehra, AGP for the Respondent - State.
---- CORAM : RAVINDRA V. GHUGE & ASHWIN D. BHOBE, JJ.
DATE : 10th SEPTEMBER, 2025 P.C. :- 1.
The Petitioner's transfer from the unaided establishment to the aided establishment, stage-wise, has already been approved by an order dated 14th September, 2018. She prays for 100% salary grants in order to earn the salary through such grants, keeping in view that seven years have passed after the order approving her transfer was passed. Reliance is placed on the judgment dated 12th March, 2021 delivered by this Court in Writ Petition (Stamp) No.93919 of 2020 (Sandhya D/o. Balkrushna Teli and Ors. v/s. The State of Maharashtra and Ors.). Gauri Gaekwad
911.WP-2297-2025.odt 2.
The learned Addl. GP submits that the Petitioner has directly approached this Court. She has not even moved a representation to Respondent No.2 regarding the allocation of 100% salary grants in aid. The learned Advocate for the Petitioner submits that the Petitioner would move an application before Respondent No.2 at the earliest and this Petition may be disposed off. 3.
In view of the above, this Petition is disposed off with liberty.
4.
Let Respondent No.2 deal with the representation of the Petitioner and, after considering all her contentions, arrive at an appropriate decision, keeping in view that her post may already have started getting 100% grant aid. Such decision be communicated to the Management as well as to the Petitioner. (ASHWIN D. BHOBE, J.) (RAVINDRA V. GHUGE, J.) Gauri Gaekwad
