Learned Counsel for the Petitioners submitted that whatever deficiencies were pointed out by the Education Officer (Secondary), Z.P. Ratnagiri were cured by the Management. However, by the impugned order, some new deficiencies have been notified by the Education Officer (Secondary) without giving opportunity to the Management to cure the same.

We have heard learned AGP for the Respondent-State, who supported the impugned order.

In our opinion, the impugned order dated 21st December 2022 can be treated as show-cause notice to the Petitioners. The Petitioners to respond to the deficiencies within a period of 2 weeks from today and place their response before the Education Officer (Secondary) Zilla Parishad, Ratnagiri. Upon considering the same, the Education Officer (Secondary) is directed to pass necessary order on the proposal within a period of six weeks from today.

Needless to mention that the Education Officer (Secondary) shall take into consideration the decision of this Court in the case of Smt. Munoli Rajashri Karabasappa Vs. State of Maharashtra, Thru. Secretary & Ors. in Writ Petition No. 8587 of 2016 and connected petitions, dated 10th July 2017.

Keeping all contentions open, the Petition stands disposed of in the aforesaid terms. No orders as to costs.
