**** Mr. Manoj Patil for the Petitioner.

Mr. S.B. Kalel, AGP for Respondent Nos. 1 to 5/State. **** SNEHA NITIN CHAVAN by SNEHA NITIN CHAVAN Date: 2024.08.08 18:42:28 +0530 CORAM : NITIN JAMDAR AND M.M. SATHAYE, JJ.

DATE : 8 AUGUST 2024 P.C. :

.

The Petitioner who was working as Education Officer has challenged the decision dated 18 April 2022 taken by the Deputy Director of Education, Mumbai. The Deputy Director of Education has come to the conclusion that the approval granted on a proposal submitted by the Educational Institute in respect of a teacher was illegal, fraudulent and in collusion with the Petitioner-Education Officer. It is observed that the concerned teacher is a daughter of the Petitioner and the Petitioner coerced the Educational Institute in her favour.

2.

The learned counsel for the Petitioner states that the Sneha Chavan

2 5-WP-2925-2024.doc observation made in the said order will prejudice the Petitioner and the Petitioner ought to have been given hearing. 3.

The impugned order sets aside the approval and it is only recommended that action needs to be taken against the Petitioner as per Rules. Therefore, if and when an action is initiated, the Petitioner has full opportunity to putforth his case. Therefore, at this stage, we are not inclined to interfere in writ jurisdiction. 4.

Writ Petition is accordingly dismissed.
