The point involved appears to be that the candidate who contested an election but not elected can be disqualified under Section 14(b) of the Maharashtra Village Panchayat Act, 1958 and the expiry of the term of elected candidate has relevance at the time of passing of order under Section 14(b). 2.

Hence, issue notice to respondent Nos. 4 to 6, returnable on 3rd April 2024.
