It is submitted by the learned counsel for the Petitioner that the inquiry conducted pursuant to the directions issued by the Maharashtra Administrative Tribunal (for short "Tribunal") in Original Application No.936 of 2016 is erroneous, inasmuch as, Respondent No.5 has wrongly taken benefit of the Government Scheme though he was not eligible to do so. It is further submitted that though the tenure of the appointment of Respondent No.5 has ended on 3rd May 2021, he is still continuing on the post of Police Patil. 2.

Issue notice to the Respondents, returnable on 12th April 2024.

The learned Additional Government Pleader waives notice for Respondent-State. The Respondent No.5 be served by all permissible modes.
