The Petitioner had earlier filed Writ Petition (St) No. 1000 of 2022 seeking benefits of Old Pension Scheme. The said Writ Petition was disposed of on 12 August 2022 directing the Respondent-State to examine the case of the Petitioner in light of law laid down by the Division Bench of this Court in Writ Petition 4748 of 2019 and Writ Petition No. 8990 of 2021 with connected Writ Petitions. In the impugned order there is no reference to these decisions. 2.

Learned AGP seeks time to take instructions from the Deputy Director of Education, who has passed the impugned order, so as to avoid any action to be taken under the contempt jurisdiction.

The learned AGP has sought time till afternoon session to take instructions from the Deputy Director of Education and stated that the Deputy Director of Education wants to contest the petition on merits by filing reply.

Our earlier order is clear and the Deputy Director of Education will keep the same in mind before taking any stand to ensure that there is no willful disregard of the law laid down in the Judgments of the Court.
