Learned counsel for the petitioner submits that the impugned order is arising out of custody proceeding which is going on between the parties before the Family Court at Bandra, Mumbai, however, the custody petition before the Family Court itself has been disposed of. 2.

In view of above, learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to approach this court in case custody petition is remanded back to the Family Court. 3.

The writ petition is dismissed as withdrawn with liberty as prayed for.
