This petition is filed under Article 226 of the Constitution of India, seeking the following substantive relief :- "b) This honorable High Court Bombay after going into legality & validity of the case, be please to issue writ of mandamus, certiorari, and or any other writ, order or direction thereby directing the respondents to make detail inquiry in respect of complaint filed by petitioner on 28.04.2021 and shall submit the report thereof, within time bound period;"

Heard Mr. Pise, learned counsel for the petitioner and Ms. Thakar, AGP for the State.

Mr. Pise would submit that the petitioner had filed a representation/complaint dated 28 April 2021 addressed to the respondent nos. 1 and 2 with regard to the alleged misappropriation of the government grants/amounts which warrants a detailed inquiry. According to the petitioner the said representation/complaint is not decided and remains pending with the respondent-Authorities. 4.

Ms. Thakar would oppose the petition. However, there is no written opposition and/or affidavit in reply on record. 5.

We have heard the learned counsel for the parties and with their assistance perused the record.

We find that the representation/complaint of the petitioner dated 28 April 2021 addressed to respondent nos. 1 and 2 ought to be decided by the respondent-Authorities in accordance with law within the time bound manner, as the same is pending since 2021. 7.

In light of the above, the following order would meet the ends of justice.

ORDER

(i) The competent authority of the respondents shall hear the petitioner on his representation/complaint dated 28 April 2021, and after hearing, pass a reasoned order in accordance with law, as expeditiously as possible, not

later than within a period of six weeks from the date this order is presented to the respondent-Authorities. (ii) All rights and contentions of the parties are expressly kept open.

(iii) Writ petition is disposed of in the above terms. No costs.
