The Petitioner has filed this writ petition praying for a direction to the Respondents to award benefits as granted to the other employees by the orders passed by this Court which are referred to in the prayer clause of the Petition. On a query, counsel for the Petitioner informs that the Petitioners have directly filed this writ petition calling upon the Respondent - employer to give these benefits without placing the orders of this Court before the employer. Before seeking a writ of mandamus, the Petitioner should atleast make a demand for the relief.

The learned counsel for the Petitioner states that Petitioner will apply to the Respondent - employer. The employer, thereafter, will
2 12 wp 4455.24.doc examine the orders passed by this Court and take necessary action as warranted in law and facts. Since we are not adjudicating this petition, we are not deemed to have overruled the contention of the Respondent-State that Petitioner should have approached the Maharashtra Administrative Tribunal.
