... Petitioner.

Versus

IES Secondary School & Ors.

... Respondents.

**** Mr. Akshay Pawar i/b. Apurva Dabholkar, for the Petitioner. Mr. Arvind G. Kothari with Ms. Nandini G. Menon, for Respondent Nos. 1 and 2.

Mr. S.B. Kalel , AGP for Respondent Nos. 3 to 5/State. **** CORAM :

RAVINDRA V. GHUGE AND ASHWIN D. BHOBE, JJ.

DATE :

3rd APRIL, 2025 P.C. :

1.

The grievance of the Petitioner in this Petition is that though she has been working as an Assistant Teacher since 1992, the proposal for seeking sanction to her post and grant of salary and allowances as per the provisions of the MEPS Act, 1977 and the Rules 1981, has not been forwarded to the Education Department despite a series of representations from 2014 till 2023. Feeling exasperated, she has preferred this Petition.

2.

The learned Advocate for the Management, though Talwalkar

10.WP4694.2024.odt belatedly, submits fairly that the proposal of the Petitioner would be forwarded to Respondent No. 3 within 15 days. Having recorded the said statement made to the Court, we direct Respondent No.3 to follow the due procedure laid down in law and after carrying out a due verification in the proposal, pass a reasoned order within 30 days. While doing so, Respondent No. 3 would take the efforts to mention the scales of salary which are payable to the Petitioner in terms of the MEPS Act and the Rules.

3.

With the above directions, this Petition is disposed off. (ASHWIN D. BHOBE, J.) (RAVINDRA V. GHUGE, J.) Talwalkar
